Terms and conditions
1 Definitions
1.1 General Terms and Conditions: these general terms and conditions;
1.2 Customer: the purchaser from Cheese In A Box with whom Cheese In A Box enters into an Agreement;
1.3 Cheese In A Box: our trade name is Cheese In A Box. Our legal entity is CheeseInaBox.nl, Maaseikstraat 61, 4826 LR Breda, the Netherlands, registered with the Dutch Chamber of Commerce (KvK) under number 69778035;
1.4 Product/Products: goods that Cheese In A Box offers on its Website, which the Customer can order or to which the Customer can subscribe;
1.5 Agreement: an agreement, of which the General Terms and Conditions form part, concerning the purchase and delivery of a Product;
1.6 Order Confirmation: as described in article 4.2;
1.7 Website: the website of Cheese In A Box, found at the URL: www.cheeseinabox.nl.
2 Applicability
2.1 The General Terms and Conditions apply to all Agreements, (email) newsletters, the Website, quotations and agreements (including subscriptions and one-off orders) concluded between Cheese In A Box and the Customer.
2.2. The Customer may only rely on deviating and/or additional arrangements if and to the extent that these have been expressly accepted by Cheese In A Box.
3 The offer
3.1 If an offer has a limited period of validity or is made subject to conditions, this will be expressly stated in the offer.
3.2 The offer contains a complete and accurate description of the products, digital content and/or services offered. The description is sufficiently detailed to enable the consumer to make a proper assessment of the offer. If CheeseInaBox.nl uses images, these are a truthful representation of the products, services and/or digital content offered. Obvious mistakes or obvious errors in the offer do not bind CheeseInaBox.nl.
3.3 Each offer contains such information that it is clear to the consumer what rights and obligations are attached to the acceptance of the offer.
3.4 Cheese and other fresh products are cut by hand, which may result in small deviations in the weight of the product. CheeseInaBox.nl strives to ensure that the weight of the ordered products matches the ordered weight as accurately as possible. Nevertheless, CheeseInaBox.nl reserves the right for the final weight of the delivered products to deviate from the ordered weight by a maximum tolerance of 5%. This deviation is considered acceptable within the limits of what is reasonable and customary in the industry.
3.5 If the weight of a delivered product is less than the ordered weight, CheeseInaBox.nl will, where possible and reasonable, try to compensate for this by making up the weight with another similar product. In this way CheeseInaBox.nl ensures that the total quantity of products delivered corresponds as accurately as possible to the weight ordered by the consumer. CheeseInaBox.nl does its utmost to ensure that the delivery meets the reasonable expectations of the consumer, taking into account the aforementioned tolerance.
4 Formation of the Agreement
4.1 An Agreement between Cheese In A Box and the Customer is concluded at the moment the Customer accepts an offer and the associated General Terms and Conditions and delivery times of Cheese In A Box, by fully and correctly completing the order form made available by Cheese In A Box.
4.2. When the Customer has accepted the offer electronically (for example on our website), Cheese In A Box will also confirm receipt of the acceptance of the offer electronically (for example by means of an Order Confirmation by email).
5 Prices and discount codes
5.1 Prices include VAT and exclude shipping costs within the Netherlands and Belgium, unless stated otherwise.
5.2 Cheese In A Box may change the prices of the Products during the term of an Agreement, in which case Cheese In A Box will inform the Customer no later than 14 days in advance and the Customer has the option to terminate the Agreement via the online account on our Website or by sending an email to info@cheeseinabox.nl, subject to the notice period as set out in article 8 of the General Terms and Conditions. If the Customer does not terminate the Agreement and continues to use the Products from the announced effective date of the changed price, the new prices apply from that effective date.
5.3 The claims of Cheese In A Box are payable immediately.
5.4 Promotions and offers are valid while stocks last.
5.5 The discount codes of Cheese In A Box may not be used for commercial purposes and/or for purposes other than those for which they were issued, and may be used and redeemed only once via the Website.
5.6 The discount code of Cheese In A Box cannot be combined with other offers and cannot be exchanged for cash.
5.7 Any (attempted) fraud or other unauthorised act may result in the use of discount codes being discontinued for that Customer.
5.8 Cheese In A Box has the right to withdraw or invalidate discount codes if it considers this necessary for any reason whatsoever.
6 Payment
6.1 For payment, the Customer may only use the payment methods offered by Cheese In A Box. The Purchaser is obliged to pay within the agreed payment term.
6.2 Products are charged via the payment method specified by the Purchaser.
6.3 If the Customer chooses the payment option ‘SEPA direct debit’, the Customer authorises the payment service provider of Cheese In A Box (for example Mollie, or another party acting on behalf of Cheese In A Box) to send recurring SEPA direct debit instructions to the Customer’s bank to debit the amount due from the Customer’s account.
6.4 It is the responsibility of the Customer to ensure that sufficient funds are available at the time of payment.
6.5 If the Customer does not agree with a SEPA direct debit as referred to in article 6.3, the Customer may have it reversed under the conditions agreed between the Customer and his or her bank. The Purchaser must contact his or her bank for this purpose within eight (8) weeks of the debit.
6.6 (Periodic) payment takes place prior to each delivery.
6.7 Should the attempts to carry out the payment again fail, Cheese In A Box reserves the right to recover the debt in another way, directly or through a third party, and to recover the associated extrajudicial collection costs from the Customer.
6.8 If a SEPA direct debit or other payment is reversed or charged back, the costs charged to Cheese In A Box for this by the payment service provider or the bank shall be borne by the Customer, unless the reversal is the result of a demonstrable error on the part of Cheese In A Box. These costs will be charged to the Customer in addition to the amount still owed for products already delivered.
6.9 Order Confirmations and payment reminders are provided by Cheese In A Box exclusively electronically.
7 Contract term, cancellation
7.1 The Customer may always cancel the Agreement entered into for a definite or indefinite period in the form of a subscription via the online account on the Website or by email to the address info@cheeseinabox.nl, except where the Agreement expressly states otherwise (for example in the case of a special promotion), all of this subject to the agreed notice period as described in article 8 of the General Terms and Conditions.
7.2 Unless the Agreement expressly states otherwise (article 7.1), the Customer may cancel a subscription at any time. There is no minimum term.
7.3 The Purchaser may cancel the Agreement in the same manner in which it was entered into.
7.4 An Agreement entered into for a definite period is not renewed automatically either.
7.5 After cancellation, nothing further will be debited. Whatever has already been paid for will still be delivered; in the case of a prepaid subscription, these are the remaining deliveries within the term. Deliveries already paid for will not be refunded.
8 The notice period
8.1 The (notice) period for termination, as described in articles 5.2 and 7.1 of the General Terms and Conditions, a change of address, as described in article 9.4 of the General Terms and Conditions, a change in Product type, as described in article 9.5 of the General Terms and Conditions, a pause, as described in article 9.10 of the General Terms and Conditions and withdrawal as described in article 11.4 of the General Terms and Conditions (together: a “Change”) is as follows: via the online account on our Website or by email to the address info@cheeseinabox.nl. The period for a Change by email is as follows: if the Change is received before Friday, this means that the Change will be processed immediately. Changes received on or after Friday take effect one week later. The period for a Change via the online account: if the Change is submitted before Sunday, this means that the Change is processed immediately. Changes received on or after Sunday take effect one week later. By way of derogation, article 7.5 applies to the termination of a subscription.
9 Performance of the Agreement, delivery, pausing and interruption of subscriptions
9.1 We deliver to the following countries: the Netherlands, Germany, Belgium, Luxembourg, France, Denmark, Austria, Italy, Portugal, Spain, Sweden and Finland.
Exceptions: Delivery to locations that are difficult to reach, such as the Wadden Islands or other remote areas, may be limited or may involve additional costs. If such locations require additional shipping costs or a longer delivery time, Cheese In A Box will communicate this to the Customer in advance.
9.2 Cheese In A Box delivers to the address provided by the Customer. Shipping costs are borne by the Customer, unless stated otherwise on the Website. After delivery, the risk of the Products passes to the Customer.
9.3 Delivery is only possible on the days indicated by Cheese In A Box. The indicated delivery day(s) are an estimate and Cheese In A Box does its utmost to deliver the Products on the delivery day(s) it has indicated. The time of delivery is not of the essence.
9.4 A change of address applies to the next delivery if the Customer has notified Cheese In A Box of this change, in accordance with the change period as described in article 8 of the General Terms and Conditions, via the online account on the Website or by email to the address info@cheeseinabox.nl. If the Customer has not submitted the change of address in the prescribed manner and before the period as described in article 8 of the General Terms and Conditions, the Customer will receive the Products at the ‘old’ address and the Customer will also pay the associated (subscription) costs. The change of address will then take effect in the following week.
9.5 A change of Product applies to the next delivery if the Customer has notified Cheese In A Box of this change, in accordance with the change period as described in article 8 of the General Terms and Conditions, via the online account on the Website or by email to the address info@cheeseinabox.nl. If the Customer has not submitted the change of Product in the prescribed manner and before the period as described in article 8 of the General Terms and Conditions, the Customer will receive the ‘old’ Products and the Customer will also pay the associated (subscription) costs. The new Products will then be delivered in the following week.
9.6 The Products to which the Customer can subscribe are sent as a (letterbox) parcel. These parcels do not fit through a letterbox as standard and the Customer must ensure that he or she can accept the parcel (or have it accepted) at the time of delivery.
9.7 The Customer is obliged to ensure that the handover of the Products to which the Customer can subscribe is possible at the delivery address provided by him. If that is not possible, you are in default with regard to acceptance. Any costs and/or damage shall be borne by the Customer, because the Customer has failed to ensure that handover of the Products at the delivery address is possible, all of the foregoing as described above.
9.8 If the handover of the Products as described in articles 9.6 and 9.7 of the General Terms and Conditions is not possible, the Agreement may be fulfilled by offering and handing over the Products at a parcel pickup point. When the Products are delivered in this way, the risk of the Products passes to the Customer after delivery and handover by the Carrier. Handover in this way is entirely at the risk of the Customer and Cheese In A Box is not liable for, for example, any spoilage or disappearance of Products.
9.9 Should the Products not yet have been (fully) paid for at the time of handover, Cheese In A Box retains title to them until the purchase price has been paid in full.
9.10 The Customer may at any time, subject to the applicable period, pause his subscription via the online account on the Website or by email to the address info@cheeseinabox.nl. The period to be observed for this is described in article 8 of the General Terms and Conditions. If the Customer has not given notice of the pause in the prescribed manner and before the period as described in article 8 of the General Terms and Conditions, the Customer will receive the Products and the Customer will also pay the associated (subscription) costs. The pause will then take effect in the following week.
10 Quality guarantee and inspection of Products
10.1 Our cheeses are vacuum-packed to guarantee quality and shelf life. In exceptional cases, a package may not be completely airtight due to an error in the vacuum process or damage during transport.
10.2 We ask the Customer to inspect the products received within 24 hours of delivery. If the Customer finds a damaged or spoiled cheese, the Customer must report this to us within this period via info@cheeseinabox.nl.
10.3 We can no longer compensate or replace reports made later than 24 hours after receipt, as we no longer have any control over the storage conditions after delivery.
11 Withdrawal
11.1 When purchasing Products, the Customer has the option to withdraw from the Agreement within 14 days without giving any reason. This withdrawal period starts a) on the day after receipt of the first Product in the case of a subscription or b) on the day after receipt of the Product in the case of a one-off order.
11.2 Products that spoil quickly or have a limited shelf life, such as cheese and other fresh Products, are excluded from the right of withdrawal after delivery. In the case of a subscription, the Customer may withdraw from the delivery of Products for which the period in article 8 of the General Terms and Conditions has not yet expired, or terminate the Agreement as described in article 7.1 of the General Terms and Conditions.
11.3 To exercise the right of withdrawal, the Customer must send an unequivocal statement to Cheese In A Box (for example by email to the address info@cheeseinabox.nl) in which he states that he withdraws from the Agreement. The Customer may use the model form below for this purpose.
11.4 If the Customer exercises the right of withdrawal, the Customer must nevertheless pay for the Products that have already been delivered to and/or ordered for the Customer by Cheese In A Box during these fourteen days. To prevent delivery (and therefore also the payment obligation) of the next Products, the Customer must observe the period as described in article 8 of the General Terms and Conditions.
11.5 If the Customer withdraws, the Customer cannot return the Products already received that fall under article 11.2; the Customer pays for them as described in article 11.4 of the General Terms and Conditions.
11.6 If the Customer wishes to exercise the right of withdrawal, the Customer may, as indicated in article 11.3 of the General Terms and Conditions, use the withdrawal form below.

13 Warranty and liability
13.1 Cheese In A Box guarantees that the Products it delivers comply, upon delivery, with the Agreement and with any statutory obligations and other government regulations.
13.2 Cheese In A Box is only liable for property damage and/or personal injury suffered by the customer if that damage arose as a direct and exclusive result of a failure by Cheese In A Box to fulfil an obligation, or in the event of intent or gross negligence on the part of Cheese In A Box or its employees. In this respect, only such damage is eligible for compensation against which Cheese In A Box is insured, or should reasonably and fairly have been insured.
13.3 Liability of Cheese In A Box for indirect damage, including consequential loss, loss of profit or income, missed savings et cetera, is excluded.
13.4 Cheese In A Box is not liable for any damage resulting from incorrect information provided to us by the Customer and/or the loss of his or her password, and the Purchaser shall indemnify and hold Cheese In A Box harmless against any claims by third parties.

13.6 If the Products of the Customer are to be delivered to a parcel pickup point or in any other manner than by delivery as described in articles 9.6 and 9.7 of the General Terms and Conditions, that method of delivery is entirely at the risk of the Customer. Cheese In A Box is not responsible for any spoilage or disappearance of Products. Nor is Cheese In A Box liable for any damage the Customer may suffer as a result.
13.7 The liability provisions in the preceding paragraphs also apply to the (personal) liability of the bodies, employees and auxiliary persons of Cheese In A Box. They may invoke these provisions.
14 Amendments
14.1 Cheese In A Box reserves the right to amend these General Terms and Conditions at any time. Cheese In A Box will notify the Customer of any intended amendments at least 14 days in advance. If the Customer objects to the amended terms, the Customer has the option to terminate the Agreement by sending an email to info@cheeseinabox.nl or via the online account on the Website, subject to the period as described in article 8 of the General Terms and Conditions. If the Customer does not terminate the Agreement and continues to use Products from the announced effective date of the amended terms, the amended terms apply to the Agreement from that moment.
15 Termination and force majeure
15.1 If the Customer fails to fulfil his obligations under this Agreement, Cheese In A Box has the choice to: a. give the Purchaser the opportunity to still fulfil his obligations within a period set by Cheese In A Box; b. terminate the Agreement in whole or in part without prior warning; Cheese In A Box at all times reserves the right, in addition to terminating the Agreement, to also recover full compensation for all damage and costs from the Customer.
15.2 Each party has the right to invoke force majeure if the Agreement cannot be performed, in whole or in part, or otherwise, or cannot be performed on time, as a result of circumstances that cannot be attributed to that party (a “Force Majeure Event”). A Force Majeure Event includes in any event: strikes, civil unrest, terrorism, exceptional weather conditions (such as temperatures of around 25 degrees Celsius and above) natural disasters, such as lightning strikes, work-to-rule actions, shortage of raw materials, delayed deliveries of Products or services by third parties that cannot be attributed to the party invoking force majeure, accidents, malfunctions, animal diseases, unforeseeable production or transport problems, increases in levies or taxes of any kind whatsoever, material price increases of raw materials or energy, the expiry, withdrawal or non-renewal of required permits, certificates, licences and the like.
15.3 If a party is confronted with a Force Majeure Event, that party is obliged to notify the other party immediately by email of the Force Majeure Event, and the obligations of that party are suspended, insofar as performance is prevented by the Force Majeure Event, without that party being liable for any shortcoming or non-performance. The reciprocal obligations of the other party are also suspended, without liability for shortcoming or non-performance.
15.4 If it can reasonably be expected that the Force Majeure Event will continue for more than two months, or if it has already continued for two months, the other party may terminate the Agreement by email or via the online account on the Website with immediate effect, without this giving rise to any right to compensation.
